
The Case is Dismissed
On January 2nd Judge England dismissed my federal
lawsuit. Although this would seem like a setback, it really is
not. Technically the judges decision seems to be correct. I was suing on
the basis of civil rights laws which is geared towards proctecting
citizens against the abuses of Public Officials. That was
something I didn't know when I filed the suit. I discovered it about a
week ago once I found a web site that had the civil rights laws.
What this means is basically I filed the suit in the wrong court. I'm in the process of rewriting the suit and filing it in state court where I will be suing on the basis of fraud, rather than on the basis that my civil rights were violated on the basis of fraud. Having been through the federal process though has given me an advantage in that they tipped their hand as to how they will defend themselves and their defense is weak. I found it interesting that I figured out my flaw in my suit but they didn't, supporting what lawyers are telling me that I have a real natural talent for this.
This case was a test case for me in that I picked an event that was of relatively minor consequence to test the judicial process and shake out my errors for the real cases. This has prepared me to file two more lawsuits against them. One will be a fraud suit in state court. The other will be a federal suit, but this one will have the facts necessary to support a civil rights charge. In the judges decision, the judge basically tells me what to do make a case that will stick.
