Case No: 98-3040-CV-S-3

Motion to Strike Defendant Vicki Stringfellow's

Motion to Dismiss

COMES NOW Plaintiff Marc Perkel, to ask that this court strike Defendant Vicki Stringfellow's motion to dismiss. In support of his motion, Plaintiff states as follows:

  1. Mr. Sharp is also a defendant in this action and his representation of Ms. Stringfellow is improper. Mr. Sharp can not legitimately represent Ms. Stringfellow. A defendant can not represent another defendant.
  2. Because Mr. Sharp can not be considered a proper attorney, this court lacks subject matter jurisdiction to consider any motion Mr. Sharp files in behalf of Ms. Stringfellow.

WHEREFORE, Plaintiff prays for the court to strike Defendant Stringfellow's motion to dismiss for lack of subject matter jurisdiction.
