FURTHERMORE: Marc Perkel states the following facts based upon his knowledge and belief.
The final judgement in the divorce case 194CC3198 relies on findings of the court from a maintenance hearing where the findings were never signed by anyone and the author of those findings is unknown. I have reason to believe the order is a forgery and/or was obtained through fraudulent means. The unsigned document, purported to be an order of the court, can be viewed on the Internet at:
http://www.perkel.com/pbl/married/signed/davis.htmThe finial judgement was appealed to the Southern District Court of Appeals, Case No. 21362-1. The final judgement in this appeal was never signed by a judge and is therefore a void judgement. Technically, this divorce is still pending before the court of appeals. The orders denying reconsideration and denying transfer to the Missouri Supreme Court were never signed by a judge. The decision by the Missouri Supreme Court denying transfer was also not signed by a judge. All these cases were signed by a clerk, and I have verified to the best of my ability that there exists no copy in the files with a judge's signature.
The lower court without prejudice dismissed the cases 198CC1666 and 198CC1753. On appeal, the Southern District Court of Appeals upheld the dismissal, but a judge never signed the decision in these two appeals. Furthermore, in upholding the dismissal, the court never decided the underlying question as to the validity of judgements that lack the signature of a judge. The court decided to not decide, and that decision to not decide was not properly signed.
The signature requirement by a judge is firmly established both in the Missouri Rules of Court (Rule 74.01a) and Missouri case law. Every case that I am aware of establishes the signature of a judge as a "bright line test". These cases include but are not limited to, Slay v. Slay, 965 S.W.2d at 845; Leonard O. Larue V. Janette Lohman, Case # 71802; Keck v. Keck No. 75021 (Mo.App. ED 05/11/1999); Martin v. Director of Revenue State of Missouri, 10 S.W.3d 618 (Mo.App. E.D. 02/15/2000); Lowery v. Air Support International, Inc., 971 S.W.2d 323, 324 (Mo.App. S.D. 1998); Rufus Rhine V. M. E. Montgomery, Magistrate Judge Of Scott County, Missouri, 422 S.W.2d 661; Griffen v. Griffen, 327 U.S. 220, 66 S. Ct. 556, 90 L. Ed. 635.
